Terms of Service

1. Acceptance of Terms

By accessing or using InterviewTry ("the Platform", "the Service") at interviewtry.com, you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms, you must not use the Platform. These Terms constitute a legally binding agreement between you and Headway Talent Consulting ("we", "us", "our").

2. Description of Service

InterviewTry is an AI-powered mock interview preparation platform that provides:

• Personalised interview questions generated based on your resume and target job description
• Real-time AI evaluation of your answers with detailed feedback and scores
• Performance reports covering communication, technical knowledge, confidence, and more
• Multiple interview tracks (e.g. Frontend, Backend, Data Science, Product Management, HR)
• Progress tracking via XP points, streaks, badges, and leaderboard rankings
• Resume upload and storage for repeated use across sessions

The Service is for interview preparation and practice purposes only. It does not guarantee employment or interview success.

3. Eligibility

• You must be at least 16 years of age to use the Platform
• If you are under 18, you confirm that you have obtained parental or guardian consent
• You must have the legal capacity to enter into a binding agreement
• You must not be prohibited from using the Service under any applicable law
• Corporate or institutional accounts must be registered by an authorised representative

4. User Accounts

Registration: You must create an account to access the Platform's core features. You agree to provide accurate, complete, and current information during registration and to keep it updated.

Credentials: You are responsible for maintaining the confidentiality of your login credentials. You must not share your account with anyone. You are responsible for all activity that occurs under your account.

One account per person: Each individual may hold only one free account. Creating duplicate accounts to bypass plan limits is a violation of these Terms and may result in immediate termination.

Social login: If you sign in using Google or GitHub, your account is governed both by these Terms and by the terms of the respective OAuth provider.

Account security: Notify us immediately at ramanand@makeuforward.in if you suspect any unauthorised access to your account.

5. Acceptable Use

You agree to use the Platform only for lawful, intended purposes. You must not:

• Use the Platform for any illegal activity or to violate any applicable law or regulation
• Attempt to reverse-engineer, decompile, scrape, or extract our AI models or proprietary systems
• Use automated scripts, bots, or crawlers to interact with the Platform
• Upload malicious files, viruses, or harmful content through the resume upload feature
• Attempt to gain unauthorised access to other users' accounts or our backend systems
• Impersonate any person, entity, or brand
• Use the Platform to train competing AI models or services
• Deliberately overload or disrupt the Platform's infrastructure
• Share, resell, or sublicense access to the Platform without written permission

Violation of this section may result in immediate account suspension and legal action.

6. Subscription & Payments

Free Plan: Provides a limited number of mock interview sessions per month. Free plan users have access to core features with usage caps as defined on the Pricing page.

Pro Plan: Provides unlimited sessions and access to premium features including advanced reports, all interview tracks, and priority support.

Enterprise Plan: Customised plans for organisations and institutions. Contact us for pricing.

Billing

• Paid plans are billed in advance on a monthly or annual cycle
• All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes
• We reserve the right to modify pricing with at least 30 days' advance notice
• Your subscription will auto-renew unless cancelled before the renewal date

Refund Policy

• Refund requests must be submitted within 7 days of payment
• Refunds are granted at our discretion if the premium features were not meaningfully used
• No refunds are provided for partial billing periods after active use

7. Intellectual Property

Our IP: All content, design, branding, software, AI models, question banks, and algorithms on the Platform are owned by or licensed to InterviewTry / Headway Talent Consulting. You may not copy, reproduce, distribute, or create derivative works without explicit written permission.

Your content: Your resume and interview responses remain your property. You grant us a limited, non-exclusive, royalty-free licence to process, store, and analyse your content solely for the purpose of providing the Service.

Feedback: If you provide suggestions or feedback about the Platform, we may use them to improve our service without any obligation to compensate you.

8. AI-Generated Content

The interview questions, evaluations, scores, and reports generated by our AI are for practice and educational purposes only. Please note:

• AI-generated feedback may not always be accurate, complete, or appropriate for every context
• Our scores and feedback do not represent the assessment criteria of any specific employer or interview panel
• We make no guarantee that practising on InterviewTry will result in success in real interviews or job offers
• AI outputs may occasionally contain errors, hallucinations, or outdated information

9. Privacy

Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your data as described in that policy.

Key points: we do not sell your data, your resume is stored privately on S3, and your passwords are hashed and never stored in plain text.

10. Disclaimers

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure at all times
• AI-generated questions or feedback will be accurate or suitable for any specific purpose
• The Platform will meet your specific interview preparation requirements
• Any defects or errors will be corrected within a specific timeframe

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

11. Limitation of Liability

To the maximum extent permitted by applicable law, InterviewTry and Headway Talent Consulting shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, profits, business, or goodwill
• Failure to secure employment or perform well in real interviews
• Errors in AI-generated feedback or reports
• Interruption or unavailability of the Service

Our total cumulative liability to you for any claim arising from your use of the Platform shall not exceed the amount you paid us in the 3 months preceding the claim.

12. Termination

By you: You may delete your account at any time from your profile settings. Deletion is permanent and will result in loss of all your session history and reports.

By us: We reserve the right to suspend or permanently terminate your account without notice if you violate these Terms, engage in fraudulent activity, or abuse the platform.

Effect of termination: Upon termination, your right to use the Service immediately ceases. Your personal data will be deleted within 30 days in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination (including IP ownership, disclaimers, and limitation of liability) shall survive.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts located in India.

14. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Display a notice in the app for all registered users
• Send an email notification for significant changes

Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Platform and may delete your account.
